Entertainment Agreement

WHent desires DJ services for an
event des NOW, THEREFORE, in consideration of the

mutual covenants contained herein, and
intending to be legally bound hereby, the
parties agree as follows:

1.        Term. This agreement shall commence
on the date hereof and remain in effect until

This agreement may be terminated or modified
during the above described term upon thirty (30)
days written notice to Contractor. In any case of
termination by Client, the deposit fee is forfeited.
For cancellation less than 30 days prior to event,
Client is responsible for half of the total fee
unless signing a NEW AGREEMENT with
Contractor within two (2) weeks of cancellation
for a substitute date within the following six (6)
months. Rescheduling for events due to
inclement weather shall be accommodated
whenever possible and are subject to availability.
In cases of proven Military Service causing the
event to be cancelled, a full refund will be
granted.

2.        Services. Client’s choice of DJ personality
is offered on a first come, first served basis. If a
specific DJ is not selected, Contractor will assign
an available DJ best suited for the event. If by
unavoidable circumstances, the scheduled DJ
personality is not able to perform on the date of
event, Contractor shall substitute a DJ
personality of similar experience.

3.  Fee and Payment Terms. Client hereby
agrees to pay Contractor a   total fee  for the
event selected above.
A 5% Discount is given if total amount is paid
in full at time of signing this agreement and is
more than six months from the event. Submit
this Agreement, signed, with $100.00 Deposit,
payable to:  Bluediamonddjs.com with major
credit card or mail check to: Blue Diamond
DJs. The balance may be paid no later than
one week prior to the event by major credit
card, check, cash, cashiers check, or money
order. All checks payable to Blue Diamond
DJs. Mail Checks to: Blue Diamond DJs,
17631 Semerad Rd Meadville, PA 16335 .
Multiple on‑line payments subject to $5.00 fee
per transaction, deposit not included. There
will be a $35.00 fee charged for all returned
checks. Gratuities given to a disc jockey at an
event are made at the sole discretion of Client.
Current mileage fees: any round trip over 100
miles from Meadville, PA, add $1.00 per mile.

Overtime Costs: When feasible, Client request
for extended playing time during event will be
accommodated. Overtime requests may be
made in half hour increments at a cost of
$50.00 per half hour or $100.00 per hour. Payment for overtime is
payable at the time overtime playing is to
begin. Fee is payable by cash or check payable
to Blue Diamond DJs.

4. Provisions. In addition to the fees stated
above which Client agrees to pay Contractor,
Client agrees to undertake the following
additional obligations which are required in
order to have a successful event:

The Client shall ensure that:
(a.) Performance facility provides DJ space
within 25 feet of 2 fully operational 110‑volt
outlet (3 prong grounded);

(b.) Facility is open at least two hours prior to
scheduled start time;

(c.) Facility meets all federal and state safety
regulations and has all appropriate music
licenses and performance permits;

(d.) Reasonable steps will be taken to protect
Blue Diamond DJ's equipment, personnel, and
music. Crowd control will be provided if
warranted;

(e.) For outdoor performances, shelter is
provided that completely covers and protects
Blue Diamond DJs equipment from adverse
weather conditions.

(f.) Provide a 2x4 or 2x8 foot table.

(g.) 2 meals.

Client accepts full responsibility and is liable
for any damages, injuries, or delays that occur
as a result of failure to comply with these
provisions. In the event circumstances deemed
by DJ  presents a real or implied threat of
injury or harm to DJ, equipment, or recording,
then DJ reserves the right to cease
performance until such time as Client resolves
the threatening situation. DJ further reserves
the right to deny any guest access to recordings
or equipment. In the unlikely event the DJ's
performance is delayed, liability is limited to
providing Client with performance time equal
to the (hourly) time that remains to be
completed.


5. Independent Contractor. Contractor shall
operate as an independent  contractor and not
as an employee or agent of Client.

6. Compliance with Applicable Laws, Statutes,
Ordinances and Regulations. During the term
of this Agreement, Contractor shall comply
with all applicable federal, state, county and
local laws, statutes, ordinances and regulations.

7. Indemnification. The Client, It’s successors
and assigns, agrees to defend, protect,
indemnify and safe harmless the Contractor, It’
s heirs, executors, administrators and assigns,
from and against any and all claims, liabilities,
or damages, arising from or out of matters
contemplated by this Agreement including (but
not limited to) Contractor’s ownership and
operation of System.
THIS AGREEMENT TO HAVE BLUE
DIAMOND DJs PERFORM IS SUBJECT
TO PROVEN DETENTION BY SICKNESS,
ACCIDENTS, RIOTS, STRIKES,
EPIDEMICS, ACTS OF GOD, OR ANY
OTHER LEGITIMATE CONDITIONS
BEYOND DJ’S CONTROL.

8. Miscellaneous.
(a.) This Agreement constitutes the entire
Agreement and understanding of the parties
for all matters specified or contemplated in this
Agreement.
(b.) This Agreement shall be binding upon and
inure to the benefit of the parties, their
successors, assigns, personal representatives
and heirs.
(c.) This Agreement shall be construed and the
rights of the parties hereto shall be governed
by the laws of the Commonwealth of
Pennsylvania. The parties consent to venue
and personal jurisdiction in Crawford County,
Pennsylvania.

IN WITNESS WHEREOF, this Agreement is
executed and the parties have hereunto set
their hands the day and year first above written.
